Privacy Statement

KAMAR Limited provides software, called KAMAR, for education providers to upload administrative information which has been collected by them. The administrative information can also be viewed by students and caregivers based on login and access permission provided by the education provider.

In most cases, the information is hosted by the education provider that holds it. KAMAR Limited provides data hosting for approximately 10% of the education providers using the software.

Information uploaded into KAMAR by education providers has been collected by them and is held by them, whether it is hosted by the education provider or KAMAR Limited. We do not use, analyse, or extract information uploaded by education providers without prior consent. An example of such is limited environment testing prior to system updates. Information used for such testing is destroyed after the update is deployed.

KAMAR Limited does collect some personal information. We hold personal information of staff nominated by their employer to act as administrators on KAMAR. We do not collect any personal information from users who access KAMAR in their capacity as a student, caregiver or teacher, unless that person is also a nominated administrator or the school has opted in to an additional service such as ‘school.kiwi’. This privacy statement applies to personal and other information collected, stored and hosted by KAMAR Limited.

1. Introduction

1.1. We, KAMAR Limited, are committed to safeguarding the privacy of our customers. This notice will explain how we will collect, store and use personal information. Personal Information means information we receive about identifiable individuals.

1.2. Should any breach of privacy occur, we will notify affected persons as appropriate.

1.3. This notice may be updated from time to time. The latest version will be available on our website.

2. Collection of Personal Information

2.1. We will not collect personal information unless it is connected with, and is necessary for, a purpose of the operation of the KAMAR software.

2.2. We will collect personal information in the following ways:

a. From the information provided to us when registering to use our product;

b. From information provided through using our products and services;

c. From any authorised third party;

d. From publicly available information.

2.3. We collect and store the following types of personal information:

a. Details of administrators nominated by educations providers, including (but not limited to) names, addresses, telephone numbers, and email addresses.

b. Details of other persons who contact us about KAMAR products, including (but not limited to) names, email addresses, and any other information disclosed in correspondence with us.

c. Details of persons who opted in to specific services provided by KAMAR such as ‘school.kiwi’, including (but not limited to) names, telephone numbers, email addresses and information sent and received using such services. 

2.4. Education providers are responsible for collecting the personal information which they upload to the KAMAR software. We store the following types of personal information on behalf of education providers:

a. Staff, Student and Caregiver details, including (but not limited to) names, addresses, telephone numbers, email addresses, date of birth, ethnicity and iwi affiliation, national student number, education attendance, academic attainment records, medical details, guidance, financial.

2.5. Before the personal information of another individual is disclosed, the individual’s consent must be obtained for the disclosure, use and storage of their information by us.

3. Use of Personal Information

3.1. We may use personal information collected by us in the following ways:

a. To provide services or products to you;

b. To verify the accuracy and suitability of, or compliance with, our terms and conditions;

c. To improve our services to you;

d. To investigate any complaint;

e. To conduct research or statistical analysis;

f. For any other purpose authorised by you.

3.2. We may use personal information collected by education providers in the following ways:

a. To conduct a final test before deployment of an update of the KAMAR software.

b. For opt-in services such as ‘school.kiwi’, which function by sending information between the education provider and staff, students or care givers.

4. Disclosure of Personal Information

4.1. We may disclose your personal information:

• To third party agencies only when the purpose of disclosure matches the purpose of collection, and only with your authority;
• To any person authorised by you;
• Where we are required by law.

5. Storage and Security of Personal Information

5.1. We will take all reasonable technical and organisational precautions to protect personal information we hold about individuals, however we do not guarantee the security of the internet. We will never ask you to disclose your username and/or password.

6. Retention of Personal Information

6.1.  We will not store personal information collected by us longer than is necessary for the purposes for which it was collected. We destroy information within one year of the completion of the purpose for which the information was collected and held.

6.2. Notwithstanding the provisions of clause 6.1, we will retain documents containing personal information:

 a. To the extent required by law; or

 b. If we believe that the documents may be necessary for any legal proceedings.

7. Access to Personal Information

7.1.  You have the right to access the personal information we hold about you.

7.2.  If the information we hold about you is incorrect you have the right to request that the information we hold about you is corrected. If it is reasonable for us to correct that information we will do so. If not, we will include in the information that we hold about you a statement of the change you requested . We will notify you of the outcome of your request.

7.3. Requests for access and/or correction of personal information collected by an education provider and uploaded by them into KAMAR should be made to that education provider. Any such request we receive will be transferred to the appropriate education provider. We encourage you to make such requests directly to the education provider in the first instance to ensure such requests have the best chance of a quick and accurate response.

7.4.  We may charge you our costs for providing any information requested that was collected and is held by us and any costs for requests to correct that information.

7.5.  If you would like to access the personal information we collected about you and that we hold, please send an email to support@kamar.nz including your full name and the details of your request. We may request further evidence of your identification.

8. Collection of Other Information

8.1.  We may also collect technical information relating to the use of our website and internet based services either by cookies and/or other means.

8.2.  This information will be used to give us a better understanding of the use of our products and services, to improve the way they work, to offer a service or product that may be more suitable, to investigate a dispute, or for troubleshooting purposes.

8.3. We use third party providers for payment services, therefore we do not collect or store any information regarding bank account or credit card details.
